These Terms and Conditions are agreed and mutually accepted by Morim & Irmão, Lda., headquartered in Rua 31 de Janeiro, 160 R/Ch Esq., 4490-533 Póvoa de Varim, registered at the Commercial Registry of Póvoa de Varim, with the Registration and Tax Identification number 500 387 540 and a social capital of €7.481,97, hereinafter referred as “Relojoaria Morim” and the person who makes a purchase through the website Relojoaria Morim – www.relojoariamorim.pt, hereinafter referred as “User”.
The contracting parties agree that their business relationship of purchase and sale is regulated exclusively by this contract, excluding any previous conditions available on the website or verbal and/or written agreement prior or subsequent to the purchase.
Relojoaria Morim can modify at any time the provisions of these Terms & Conditions, so the user should read them whenever visiting the website.
By connecting to the website, the User agrees to abide these Terms and Conditions
1. Responsibility
Relojoaria Morim is not responsible for any violation of the current legislation in the country of the purchased items, particularly with regard to customs duties,fees and other charges, which are always of the User responsibility
Relojoaria Morim declines any liability for any damage caused to the User for the use of emerging Internet network interference or external intrusion to our site, communications outages, computer viruses, faults or disconnections of computer system or any other fortuitous cause or major force under the Portuguese law.
Although the marketed products have features and performance compatible with professional use, Relojoaria Morim does not direct its offer to a professional public,
which is why Relojoaria Morim is not responsible for any loss arising from the professional use of the sold items.
2. Price and Shipping costs
Selling prices of the listed items on the website are in Euros (EUR) and includes VAT at the rate currently statutory in Portugal.
Transportation costs, made up of the postage and the packaging are responsibility of the User and will be fixed for the entire order (combined shipping).
Relojoaria Morim reserves the right to modify at any time the selling prices and the transport costs, but always before the purchase.
Relojoaria Morim reserves the right to cancel a buy if the stated price is obviously wrong, regardless of the cause that caused the error (computer bug,error, technical or human etc.).
3. Product Information
The photographs illustrating the products are not for sale, serving only to show an exemplar of the item for sale.
Relojoaria Morim. accepts no responsibility for the content and validity of the technical data sheets and the description of the items provided by the respective manufacturers.
4. Security
Relojoaria Morim guarantees the confidentiality of the User’s data through the use of a secure server, that is, the use of a coding and encryption system commonly referred as SSL for the protection of data transmission.
5. Availability
After the payment, Relojoaria Morim will deliver/dispatch the sold item(s) whenever they are in stock.
Should the sold item not to be in stock, Relojoaria Morim will contact the User within 5 days of the payment, by email or phone, informing the User of the expected date for the delivery of the sold item.
If the sold item is not in stock and exceptionally discontinued, the User may choose the refund of the purchase price or the purchase of another item .
Relojoaria Morim is not responsible for any damages, direct or indirect, arising from the unavailability of the sold item and/or the loss of profits arising from the same cause.
6. Registration
In order to purchase, the User must register in advance, refraining from using other identities different of his/her own, providing correct personal data and addresses, thus allowing Relojoaria Morim to properly process the orders.
The User is responsible for the truthfulness of the information communicated to Relojoaria Morim. The User will update the provided information if such is necessary due to information changes.
Relojoaria Morim declines all responsibility for any delay and/or the impossibility to process and dispatch the order due to error or omission on the data provided by the User.
When registered, a User account with a username and password is assigned to the User. The User is responsible for not disclosing the username and password for the website in order to prevent third parties from accessing, unauthorized or improperly, to your User Account.
7. Order
Once registered, the User can make purchases on the website.
Confirmation of the availability of the purchased items and the acceptance of the order will be carried out by e-mail or, exceptionally, by telephone.
8. Payment
Relojoaria Morim offers the User the following ways of payment:

- ATM
9. Delivery
The delivery of the purchased items will be done to the address provided by the User.
Relojoaria Morim does not make deliveries to PO Boxes.
Relojoaria Morim is committed to deliver the purchased items as soon as possible and to make every possible effort in order for the the delivery to take place within 30 days of the payment, except for items that do not exist in stock, for which the user has been advised of the exceptional delay.
Relojoaria Morim delivers only on weekdays, not be considered as such weekends and national and local holidays.
Relojoaria Morim is not liable for any damages, direct or indirect, arising from delays in delivery attributable to the carrier or any third party at the service of the carrier.
10. Returns
Relojoaria Morim accepts the exchange or the return of the sold items. To this end the User must notify Relojoaria Morim of such intention in writing, via e-mail or letter to, within 15 days from the date of receipt of the purchased items by the User and proceed, in the same amount of time (15 days), to their return along with the respective invoice.
Relojoaria Morim will not accept exchanges or returns without the User previously stating such intention and presenting the reason for doing so and providing directions for the return.

As a rule, the exchange or return of purchased items must meet the following conditions:
- Return of items in a condition of new, without any sign of use, with original packaging and other elements that accompany the item, including manuals, warranty certificates, protection films, safety labels and invoice ;
- We do not accept custom according to the User specifications products changeovers;
- The costs of transport of the item being returned, including delivery, loss, delays, damage that may affect the item during transport, are the sole responsibility of the User;
- Relojoaria Morim will only assume the cost of return if the item is found already damaged when received by the User, in which case the User will be responsible to prove such fact.
All items will be checked on arrival to our services and will only be accepted for exchange or return those who comply with the conditions of return.
If you choose to be refunded of the paid price, shipping fees and/or charges are non-refundable.
Refunds will take place by Bank Transfer to the bank account specified by the User.
11. Warranty
All watches sold by Relojoaria Morim are covered by two years manufacturer’s warranty.
The warranty does not cover all the added costs to the price of the sold item, and in particular the costs regarding transport and taxes, which are responsibility of the User.
12. Privacy and Protection of Personal Data
The data collected on this website is intended for the processing of orders, communication with the Users, processing of requests for information and possible complaints, statistical analysis and can also be used for direct marketing purposes.
All Users are entitled to access, rectify and delete personal data.

Unless expressly stated otherwise, the User authorizes Relojoaria Morim to send to the User information about products and services that may be of interest, using the User’s data for direct marketing purposes via any channel of communication, including e-mail, SMS, MMS or other means of automatic calling.
Relojoaria Morim will not share with third parties in any capacity it’s user database.
13. Applicable Law and Forum
Excluding any other, Portuguese law is applicable to all business relationships and any disputes where Relojoaria Morim intervenes.
Any disputes arising from any purchase agreement entered into under these General Conditions of Sale will be settled by the competent Judicial Court of Maia, renouncing the contracting parties to any other.
